Cocco's Policies - Legal Questions
Personal Information Privacy Policy
As a Customer, when you make a purchase, you may be required to submit personal infomation as a part of security verification. Any concerns you may have are understandable; we would like to assure you that we take every precaution to safeguard this information and do not share it with anyone.
Information pertaining to the purchase of website subscriptions by credit card or bank payments is not collected by us but rather is retained by the particular processor (eg, CCBill, Verotel, etc). For their privacy policies please consult their websites; however we can provide reasonable assurance that extremely high standards of security of information are maintained by these reputable companies and that they only use your personal information for the purpose of concluding a particular transaction. We are able to access that information but do so only to assist customers with their own accounts.
Customer information pertaining to the purchase of tangible goods such as DVD disks is entered into our local database for the purpose of tracking and shipping orders. We DO NOT use or keep a record of credit card account numbers. Our database, which primarily holds names and addresses is on a password-protected computer in secure, locked facilities with authorized-personel-only access.
We may contact you at your email address from time to time as part of providing you with service relating to the goods and/or services we are providing you with.
We may, from time to time, offer customers inclusion in an email mailing list compiled for a specific informational purpose of which the customer is informed in advance and which the customer must voluntarily sign-up for. Deletion from the list is always offered.

Photo/Video Contributor/Model Privacy
As a contributor of photos and videos or as a model/subject in the images you may be concerned about maintaining an anonymous identity. We would like to assure you that maintaining that personal privacy for you is of utmost importance to us. We would never reveal anything about you to anyone unless forced to under extreme circumstances, something which we have not had happen ever in the decade we have been reporting about places and events around the world. A possible example would be that if you submit photos that are not your own and a copyright issue comes up, then yes we would give the plaintiff's lawyer all the info about you that we can - so only send us your own photos!
Occasionally we get requests for communication between contributors. In this case we do not simply give out email addresses. Often we ignore the request if it is not a trusted long-time member. Otherwise we would consult with the person to be contacted.
Your public face is in the form of a nickname. You may provide an email address to post with your submission, if you like, but you do this at your own risk.

Are the Photos and Videos "Voyeurism"?
No, the images and videos on this website do not fall into the legal definition of "voyeurism".
Examples of photographic "voyeurism" would happen with hidden bathroom/bedroom cameras, shooting through windows into buildings, and "upskirt" shooting. In these cases, individuals are actually hiding their bodies within their private setting or clothing and the camera has been deliberately placed to violate this barrier. We do not show anything like this.
We only report on times and places in which people deliberately reveal their bodies and do so in what is clearly an outdoor or public setting. A subject who claims an invasion of privacy under these circumstances is being highly unreasonable. People who deliberately engage in this act, one that is generally taboo in our society, do so because they believe, as we do, in the freedom of the body and normally celebrate the fact that their expression has been noted.
The photos shown on coccozella.com are actually no different than any other public records... photos of cars, people in costumes, airplanes, and athletic events. The only difference is that the people are not wearing clothes. Since it is both our attitude and the attitude of the nudist to "normalize" the human body, then these images should not fall into any kind of special category just because the people are clothes-free. To consider the content on Coccozella as "adult" or "pornographic" is more a reflection of the closed-mindedness and prejudices of the person uttering the accusation than the website itself. The photographs shown here fall into the category generally called "street photography" of which there is a long tradition; photographers have established the legal right to photograph people in public without repercussions.

So, You Want your Photo Removed...
Since the images and video clips on this site are "documentary" in nature and fall into the category of Photo-Journalism, formal permission is not required from the persons appearing in the images or video clips.
The persons depicted are generally individuals who draw attention to themselves by appearing, behaving, or performing in public in a manner that is regarded as taboo by most of society. It is therefore of historical, sociological, and general informational value that we present here a forum within which these recordings can be shared in a private setting.
If you should see yourself or someone you know in one of the pictures or video clips and believe that you have a right to insist on removal of the image or clip from this forum, we will consider your case. You must present your circumstances in a reasonable manner and send at least one photo for identification purposes. Requests not conforming to this will be ignored.

Photographic Ownership Issues
When you send us photos/videos, you are thereby agreeing to allow us to exhibit them in exchange for access to the membership area for a set subscription time which we determine based on quantity and quality. The photos/videos remain in the archive in perpetuity, but most people will only see them within the first few months. In most cases, contributors who send us a lot of material and on a somewhat continuous basis have continuing membership. The copyright in the photos/videos remains with the contributor and is not restricted from using his/her photos/videos for whatever other purpose they want. Please check the submission pages for more information.
If you have found that images you own the copyright to have been exhibited here without your permission it is because a contributor has cheated us. We now usually get full-size digital images from people, so we know they were not taken from another website. We have become quite good at sniffing out cheaters but sometimes we fail. Just let us know and please provide some proof the images in question belong to you and we'll take care of things. We do take copyright claims seriously.
